These Terms & Conditions ("Terms") govern your use of the SlapCut mobile application ("SlapCut", the "App", "we", "us" or "our"), published by Apparence.io, a company registered in France. By downloading, installing or using SlapCut, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of terms

By installing or using SlapCut you confirm that you are at least 13 years old (or the minimum age of digital consent in your jurisdiction) and that you accept these Terms and our Privacy Policy.

2. License

Subject to these Terms, Apparence.io grants you a limited, non-exclusive, non-transferable, revocable license to install and use SlapCut on an iOS device that you own or control, for your personal or internal business use.

As an iOS app, SlapCut is also licensed to you under Apple's standard Licensed Application End User License Agreement, which you can read here: apple.com/legal/internet-services/itunes/dev/stdeula. In case of conflict between these Terms and Apple's EULA, these Terms prevail except where Apple's EULA is more restrictive.

3. Your content

Videos, audio and any content you record, edit or export with SlapCut ("Your Content") belong to you. SlapCut processes Your Content locally on your device and does not upload it to our servers. You are solely responsible for Your Content and for ensuring you have the rights to record any person, place or material it contains.

4. Acceptable use

You agree not to:

• use SlapCut to record, produce or distribute illegal, infringing, defamatory or harmful content;
• record people without the consent required by your local law;
• reverse engineer, decompile, disassemble or attempt to extract the source code of the App, except where this restriction is prohibited by law;
• resell, sublicense, rent or commercially redistribute the App itself;
• use automated tools, scripts or modified clients to interact with the App;
• interfere with the security or integrity of the App or any service it relies on.

5. Intellectual property

SlapCut, the SlapCut name and logo, the App's source code, design, gestures, icons and all related materials are the exclusive property of Apparence.io and are protected by French and international copyright, trademark and other intellectual property laws. Nothing in these Terms transfers any ownership to you.

6. Updates and availability

We may release updates, change features, or discontinue parts of SlapCut at any time. Updates may be required to keep using the App. We do not guarantee that SlapCut will always be available, error-free or compatible with every device or iOS version.

7. Disclaimer of warranties

SlapCut is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the auto-cut, gesture recognition or any other feature will work without errors or that Your Content will not be lost. Always keep your own backups of important recordings.

8. Limitation of liability

To the maximum extent permitted by law, Apparence.io will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or videos, arising from or relating to your use of SlapCut. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months preceding the claim, or (b) EUR 50.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including consumer rights in your jurisdiction.

9. Termination

You can stop using SlapCut at any time by deleting it from your device. We may suspend or terminate your license if you breach these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, governing law) will continue to apply.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Material changes will be communicated through the App or on this page. Continued use of SlapCut after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by French law. Any dispute arising from or related to the App or these Terms will be submitted to the competent courts of France, subject to mandatory consumer protection rules in your country of residence.
